AGREEMENT BETWEEN YOU AND FAREGEEK

 

We have done everything possible to make this site user-friendly, informative and secure. If you would like to know more about our responsibilities and yours, please read the information below. If you do not agree to this information, please do not use this site.
This site is owned by Faregeek.com and is provided mainly for residents of North America.

 


1. Travel information

Our web site displays information about travel locations, airfares, flight times and dates, tours, packages, insurance, cruises, transportation, foreign currency, schedules, travel companies and other material related to travel.

This information is supplied to us by Third Party providers, such as airlines, hotels, transportation and information suppliers. We have taken reasonable care to ensure it is correct and up to date; however we cannot check the accuracy of such information.

We accept no responsibility for information supplied to us by Third Parties. We recommend you confirm all information contained on or linked from our web site with the Third Party provider.

You are responsible for obtaining all passport, visa and health information required. We will assist you to obtain such information; however, the final responsibility for obtaining the necessary information and complying with any passport, visa and health requirements remains with you, solely.
The details of the prices, packages, tours, flights and other information displayed on the web site are subject to change without notice. The travel products and services described on the web site are subject to availability.

 

 

2. Prices

All prices displayed on the web site are subject to change without notice. This is because the airlines and other Third Party providers may change the prices at any time.
Special conditions may apply to the prices set out on the web site. To determine such conditions, you must contact us or the relevant Third Party provider.

The prices set out on the web site may not include taxes or airport charges or other fees. In this case taxes, airport charges and any additional fees will be displayed during the booking process but prior to payment submission. Pricing is displayed in US and/or Canadian currency.



3. Air Fares

Prices are either in Canadian or USA dollars unless otherwise stated. Any increased change in pricing quoted at time of booking to time of issuance of travel documents that is more than 7% of the booking quoted price, except any increase resulting from an increase in Retail Sales Tax or Federal Goods & Services Tax, shall entitle the customer to cancel the booking and obtain a full refund. Any price increases occurring after issuance of travel documents are our responsibility, except for increases in Retail Sales Tax or Federal Goods & Services Tax. No price increases are permitted once payment has been made in full and travel documents have been issued.


4. Confirmation

 In some circumstances, your booking will provide you with a confirmation number before a ticket has been issued. The booking process is not complete until you have received a ticket number. In some cases, due to unforeseen errors we may be unable to honor a fare quoted.

5. Credit Card

You agree to authorize the ticket issuer to charge your credit card number the amount that is shown as the Grand Total.

6. Passports/Visas/Health Requirements

Prior to booking your trip, you should ensure that you meet the passport, visa, affidavit, health and other requirements of the countries you wish to visit and those that you transit (even if it is for a plane change). Canadian / USA citizens are required to present a current valid passport for entry or transit through most countries; otherwise, entry or transit may be denied. We remind you that living standards and practices at your travel destination and the conditions there with respect to the provision of utilities, services and accommodation may differ from those found in Canada / USA.
Please note that many countries require that your passport be valid for a period of (a minimum) six months beyond your return date (please see chart below for easy reference). Obtaining passports and visas may require lengthy processing times and entry to another country may be refused even if your required information and travel documents are complete. We accept no responsibility if you should be denied boarding or deported for any reason including your age.

7. Entry Requirements for United States

The department of Homeland Security of the United States of America has introduced new laws effective January 23, 2007 governing the entry requirements to the United States by air. These new laws include mandatory passports for all travelers including Canadian and American citizens. Please ensure that your passport is valid for at least 6 months past your desired return date to ensure that there are not any delays in regards to US Immigration.

8. Travel Insurance

We strongly recommend travel insurance to cover you for cancellation, health, baggage and other losses including out-of-province health insurance, if applicable. For every sale, FareGeek offers the option to purchase travel insurance to cover the customer against any unforeseen circumstances that may occur prior to, during or after your trip. There are different types of insurance packages available and the purchase of insurance is an optional decision to the customer.
It is the customer’s responsibility to read and familiarize themselves with the travel insurance policy to understand what their purchased travel insurance covers and under what conditions. Customers who purchased trip insurance  & want to make an insurance claim, they must contact Travel Guard directly for any changes, cancellations, clarifications and/or claims.    

9. Cancellation / Changes

If you need to change or cancel your travel plans, it is your responsibility to notify us in writing of such a request. Notifying us is not enough in many cases as we have automated software to issue many of our tickets instantly. These tickets are discount tickets, which have restrictions on them and may be up to 100% non-refundable and non-changeable. We charge a service fee for any changes or cancellations to fares if the airline allows it. In addition to our charges, most airlines also have a penalty or cancellation fee for any changes or cancellations to fares.
Customers who do not appear or 'no show' for their flight will forfeit the entire fare paid. If you arrive at the airport late or are denied boarding you will forfeit the entire fare paid.

10. Lost Tickets

If you lose your tickets, it may be possible to re-issue them for a fee. The amount payable will depend on the circumstances of the loss and how close to the travel date you discover it. However, not all tickets can be re-issued; which
Is another good reason for ensuring you have sufficient insurance coverage. Tickets will be dispatched to you in accordance with your instructions and we accept no responsibility for their delivery.


11. Best Price Best Price Guarantee


  • 1. If you frequently purchase airfares online, you'll know that once your reservation is complete then typically you're locked in and committed. At this point most airfares are simply non-refundable, or otherwise carry large cancellation fees. With our Best Price Guarantee you can avoid both scenarios and save without hesitation!

  • 2. Find an airfare deal on our site, select a Best Price Guarantee for just $14.99 per person, then rest easy knowing your cheap flights have been secured, whilst still being fully refundable without penalty within the same day.

  • 3. The $14.99 fee will be charged per person and will be payable at the time the reservation is made. Once fulfilled, the BPG fee cannot be cancelled, nor refunded, at anytime.

  • 4. If you select the BPG option (at a fee of $14.99 per person), the following terms and conditions apply:


You may cancel any flight-only reservation within same day of booking and receive a full refund (excluding the $14.99 fee per person). * If you find a lower price on the same flights, or you’ve noticed that the airfare drops, within same day of booking you can cancel and receive a full refund (excluding the $14.99 fee).


  • All cancellation requests must be wholly submitted, either via email Fares@faregeek.com, or over the phone on +1-888-856-9327, within same day of a completed reservation request (i.e. when the booking was made).


12. Frequent Flyer Programs

Almost all of our Airfares allow accumulation of frequent flyer miles. You enter your frequent flyer program and number in our booking process. Your frequent flyer information is sent to the airline once your ticket is issued. Air Canada Aeroplan points are available on all of our flights at the time of booking. You have the opportunity to add your Aeroplan number after your booking is made as well, with the exception of Air Canada Tango fares. Aeroplan numbers for Tango flights cannot be added after a booking has been made with FareGeek.

 

 

13. Suitability of travel products and services

We do not represent that any travel products and services set out on our web site will be suitable for you. You release us from any claims in relation to the travel products and services described on our web site, including but not limited to claims that the travel products and services are not suitable.

 

14. Specials

The rules in this clause apply to 'specials' displayed on our web site. The site rules set out above also apply to 'specials'.

'Specials' are available for a limited time. You must check with us whether a 'special' displayed on our web site is still available.

There may be particular terms and conditions that apply to 'specials'. You must contact us or the Third Party provider of the 'special' to determine whether any particular terms and conditions apply.

You must pay for 'specials' booked by you and confirmed by us within 72 hours of booking confirmation, unless otherwise agreed by us in writing. Failure to pay for the 'special' within this time may result in cancellation of the booking. We accept no responsibility for loss incurred due to cancellation in these circumstances.

 

15. Intellectual Property

This web site, the software, design, text and graphics comprised in this web site and the selection and layout of this web site, are owned or licensed by us or their respective owners and are protected by Canadian and international intellectual property laws.

You may view and electronically copy the pages of this web site in the usual operation of your web browser in visiting this site, but for no other purpose.

Any other use of the material contained on this web site, such as copying, distributing, selling, modifying, transmitting, reusing, re-posting or publishing is strictly prohibited, without the specific written permission of the respective owners.

Unauthorized use of materials from our site will not only breach this agreement, but may violate copyright and other laws.

Certain trademarks, service-marks, business names, company names, logos, trade names and presentation techniques (trade dress) used on this web site are owned by us or our licensors. In particular, we own the trademark Faregeek. You do not have any right or license to use them.

 

16. Your Use

You must use this site in a responsible and co-operative manner.

You must not:

  • make any fraudulent, speculative or false enquiries, bookings, reservations or requests using this web site;
  • use another's name, ID or password without permission;
  • use the web site while impersonating another person;
  • post or transmit to or via the web site any unlawful, threatening, defamatory, libellous, obscene, indecent, inflammatory or pornographic material or any material that could give rise to civil or criminal proceedings;
  • tamper with, hinder the operation of or make unauthorized modifications to the web site;
  • delete data from the web site without our permission;

Subject our "Privacy Policy", we will not disclose personal information about you (such as your name, contact details, browsing habits) which is provided by you or via your browser, without your permission unless we are required or need to do so to comply with your request or instructions.

We and our Third Party providers of travel and travel related products and services may disclose personal information about you to others where directly connected with facilitating your travel arrangements and bookings. For example, we may disclose information about you to airlines, hotels, car rental companies in facilitating your travel arrangements.

We may disclose aggregated information about users and use statistics relating to our web site and aggregated information about our sales and trading patterns to others.

 

20. Disclaimer

We do not warrant or represent that the content of this web site is accurate, up-to-date or complete, nor that it does not infringe the rights of others.

We are providing this web site and its contents on an 'as is' basis.

We make no representations or warranties of any kind with respect to the web site, its contents or any of the products or services supplied through this web site.

We will provide any notices to you by email to any email address provided by you.

Notices will be taken to have been received 24 hours after the email is sent, unless the sending party receives notice that the address is invalid or that the email has not been received.

 

27. Governing law

If any dispute arises about this agreement or how this agreement applies or arising out of your use of this site, at our sole discretion, we will choose the applicable legal jurisdiction.

 

28. General

If any of these terms of use is invalid or unenforceable, it will be struck out, and the remaining terms will remain in force.

Headings are for reference purposes only.

If we do not act in relation to a breach by you or others of these Site Rules, this does not waive our right to act with respect to subsequent or similar breaches.

In this Agreement, the term 'web site' includes any e-mail bulletins or other content that we provide to you via or initiated from this web site.
